Prosedur penyelesaian sengketa hukum di lingkungan Universitas Islam Indonesia
Kepala Badan Etika dan Hukum (BEH) baik secara langsung atau melalui staf menerima pengaduan dari sivitas akademika UII terkait kasus sengketa hukum, pelanggaran hukum, asusila, pembunuhan karakter dan pengaduan lainnya dalam lingkup Etika dan Hukum, pada setiap hari dan jam kerja, atau Kepala BEH menerima penugasan dari Pimpinan Universitas untuk menyelesaikan sengketa hukum, pada setiap hari dan jam kerja atau dapat di luar waktu tersebut apabila dalam kondisi darurat.
The Head of Bidang Etika dan Hukum (BEH), either directly or through staff, receives complaints from the academic community of UII regarding legal disputes, legal violations, immoral acts, character assassination, and other complaints within the scope of Ethics and Law. These are accepted on every working day and during working hours. Alternatively, the Head of BEH may receive assignments from the Head of University to resolve legal disputes, on every working day and during working hours, or outside of those times if the situation is an emergency.
Kepala BEH melalui Tim yang dibentuk, meminta keterangan atau informasi lebih rinci terkait dengan kronologi kasus hukum yang diadukan baik secara lisan maupun tertulis dari pihak pengadu atau pemberi tugas, paling lambat 2 (dua) hari sejak diterimanya pengaduan.
The Head of BEH, through the Team formed for this purpose, requests detailed statements or further information regarding the chronology of the reported legal case—either orally or in writing—from the complainant or the party assigning the task, no later than 2 (two) days after the receipt of the complaint.
Tim BEH menangani sengketa, melaksanakan mediasi, menelusuri bukti-bukti, memanggil dan menggali informasi dari para saksi atau pihak-pihak yang terlibat dengan berpedoman pada Peraturan yang berlaku di Universitas Islam Indonesia.
The Team handles disputes, conducts mediation, traces evidence, summons and gathers information from witnesses or the involved parties, while adhering to the applicable regulations at Universitas Islam Indonesia.
Tim BEH melaporkan hasil kajian yuridis terkait penyelesaian sengketa hukum kepada Pimpinan Universitas, paling lambat 7 (tujuh) hari setelah dilakukan langkah-langkah penelusuran bukti, mediasi dan penggalian keterangan dari para saksi dan pihak-pihak yang terlibat.
The Team reports the results of the juridical review regarding the resolution of the legal dispute to the University Leadership, no later than 7 (seven) days after the completion of the steps involving evidence tracing, mediation, and gathering statements from witnesses and the involved parties.
Kepala BEH berkoordinasi dengan Tim melaksanakan langkah-langkah penyelesaian sengketa berdasarkan rekomendasi hasil diskusi dengan Pimpinan Universitas dalam bentuk sanksi berdasarkan Peraturan yang berlaku di UII, solusi damai atau melimpahkan sengketa tersebut kepada Aparat Hukum (Kepolisian/Pihak Kejaksaan).
The Head of BEH, in coordination with the Team, carries out the steps for dispute resolution based on the recommendations resulting from discussions with the University Leadership. This is implemented in the form of sanctions in accordance with the regulations in force at Universitas Islam Indonesia (UII), a peaceful resolution, or referral of the dispute to the relevant law enforcement authorities (Police/Prosecutor’s Office).
Kepala BEH melalui Staf mendokumentasikan seluruh berkas penyelesaian sengketa hukum berdasarkan Daftar Dokumen Mutu Badan Etika dan Hukum, paling lambat 2 (dua) hari sejak sengketa hukum dinyatakan selesai.
The Head of BEH, through the Staffs, documents all files related to the resolution of the legal dispute in accordance with the Quality Control Document of the BEH, no later than 2 (two) days after the legal dispute is declared resolved.
